1Introduction and Scope
1.1 Agreement to Terms
These Terms and Conditions (the "Terms") constitute a legally binding agreement between you (the "Client", "User", or "you") and MONZA GRUPPO d.o.o., trading as SeaGull Dubrovnik (the "Company", "we", "us", or "our"), governing your use of our website https://seagulldubrovnik.com (the "Website") and the booking of our boat tour services (the "Services").
⚠️ By accessing our Website, making an inquiry, or booking a tour, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our Website or Services.
1.2 Scope of Services
SeaGull Dubrovnik provides private and small-group boat tours in the Dubrovnik region, including:
- Blue Cave tours
- Elaphiti Islands tours
- Sunset cruises
- Mljet National Park excursions
- Tailor-made private charters
All tours are subject to availability, weather conditions, and the final decision of the boat captain.

We are a registered company in the Republic of Croatia, operating in accordance with Croatian maritime law, tourism regulations, and all applicable EU directives.
3Definitions
For the purposes of these Terms, the following definitions apply:
Booking
A confirmed reservation subject to payment of required deposit or full amount
Captain
Licensed boat operator employed or contracted by the Company
Force Majeure
Unforeseeable circumstances beyond Company control (see Section 7)
No-Show
Failure to appear at meeting point without prior notice
Chargeback
Disputed payment transaction initiated via bank/card issuer
Tour
Specific boat excursion including agreed route, duration, and vessel
4Booking and Reservations
4.1 How to Book
Bookings can be made through:

- Direct email to info@seagulldubrovnik.com
- WhatsApp messaging to +385 91 916 7163
4.2 Booking Confirmation
A booking is considered confirmed only when:
- The Client has received written confirmation from the Company via email or WhatsApp, AND
- The required deposit or full payment has been received and processed by the Company.
Unconfirmed inquiries do not guarantee availability or pricing.
4.3 Deposit and Payment
A deposit (typically 30-50% of tour price) is required to confirm your reservation. The remaining balance must be paid before tour departure or as agreed in booking confirmation.
Failure to pay the full amount by the agreed deadline may result in cancellation without refund.
5Pricing and Payments
All prices are quoted in Euros (EUR) and are valid at the time of booking confirmation.
5.4 Payment Processing via Stripe
Payments are processed securely through Stripe, a PCI DSS Level 1 certified payment provider. The Company does not store your full credit card details.
By making a payment, you authorize the Company to charge your payment method for the agreed amount.
6Cancellation and Refund Policy

6.1 Cancellations by the Client
If you need to cancel, you must notify us in writing (email to info@seagulldubrovnik.com or WhatsApp) as soon as possible.

📊 Example Calculation:
Tour Date: June 15
Tour Price: 400 EUR
Cancel June 1 (14 days): Refund 340 EUR (85%), Fee 60 EUR (15%)
Cancel June 8 (7 days): Refund 200 EUR (50%)
Cancel June 13 (2 days): NO REFUND
The 15% administrative fee covers: payment processing costs, communication & admin work, and lost opportunity to rebook the time slot.
6.6 Chargeback Prohibition
🚫 CRITICAL: Anti-Chargeback Clause
The Client agrees to resolve any disputes directly with the Company BEFORE initiating a chargeback. Chargebacks are considered a breach of these Terms.
If a chargeback is initiated:
- Company will provide evidence to Stripe that Services were provided or cancellation terms violated
- Client liable for chargeback fees, administrative costs, and legal expenses
- Client may be banned from future bookings
- Company reserves right to pursue legal action to recover losses
Valid refund reasons are covered in Sections 6.1-6.3. Contact us first. Fraudulent chargebacks will be prosecuted.
7Force Majeure
7.1 Definition
"Force Majeure" means any event beyond the Company's reasonable control, including:

- Wildfires

- Port authority bans
- Unsafe sea conditions
Health Emergencies
- Pandemics
- Epidemics
- Quarantines
- Travel bans

- Port closures
- Maritime restrictions
Maritime Incidents
- Collisions
- Salvage
- Search & rescue
- Channel blockage
Technical Failures
- Critical equipment breakdown
- Engine failure
- Steering malfunction
Labor Disruptions
- Strikes
- Lockouts
- Labor disputes
7.2 Effect of Force Majeure
If a Force Majeure event occurs:
- Company is excused from performance for event duration
- Company is NOT LIABLE for failure to provide Services
- NO COMPENSATION owed for indirect losses or expenses
7.3 Client's Rights During Force Majeure
If tour cancelled due to Force Majeure:
✅ Option 1: Reschedule
Full credit applied to new booking (preferred option, subject to availability)
💰 Option 2: Full Refund
If rescheduling not possible (at Company discretion)
Company NOT LIABLE for airfare, accommodation, or consequential damages during Force Majeure events.
8Weather and Sea Conditions
⚓ Captain's Final Authority
The Captain has absolute and final authority to determine whether weather and sea conditions are safe for departure. Decisions made per Croatian Maritime Code, international standards, and professional judgment.
Client must accept Captain's decisions without dispute. Refusal to comply may result in tour termination without refund.
9Safety and Passenger Responsibilities
9.1 Inherent Risk Acknowledgment
⚠️ BY BOOKING, YOU ACKNOWLEDGE AND ACCEPT:
Participation in boat tours involves INHERENT RISKS associated with maritime activities, including but not limited to:
- Changing weather and sea conditions
- Vessel movement, waves, and turbulence
- Wet and slippery surfaces
- Exposure to sun, wind, and saltwater
- Swimming and snorkeling in open water
- Interaction with marine environment
THESE RISKS ARE INTEGRAL TO MARITIME ACTIVITIES AND CANNOT BE ELIMINATED.
By boarding, you confirm you understand these risks, voluntarily assume them, and will not hold the Company liable for injuries arising from inherent maritime risks.
9.2 Compliance with Captain's Instructions
All passengers MUST:
- Follow Captain's instructions at all times
- Wear life jackets when required
- Remain seated while boat in motion (unless permitted)
- Avoid interfering with vessel operation
Failure to comply = immediate tour termination without refund.
9.3 Alcohol and Substances
Passengers are PROHIBITED from:
- Boarding while intoxicated or under the influence of drugs
- Consuming excessive alcohol that impairs safety or behavior
The Captain reserves the right to:
- Refuse boarding to intoxicated individuals (No-Show policy applies - no refund)
- Terminate tour if passenger becomes disruptive (no refund)
10Liability and Limitation of Liability
10.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Company's total liability for any claim SHALL NOT EXCEED the total amount paid by the Client for the specific tour.
📊 Example:
Tour Price Paid: 500 EUR
Maximum Liability: 500 EUR
This applies regardless of legal theory (negligence, breach of contract, strict liability, etc.)
10.2 Exclusion of Indirect Damages
Company is NOT LIABLE for:
- Lost profits or vacation time
- Missed flights or connections
- Hotel or accommodation costs
- Emotional distress or disappointment
- Damage to reputation
11Insurance
11.1 Company Insurance
The Company maintains all legally required insurance per Croatian Maritime Code and EU regulations.
✅ What IS Covered:
- Hull & machinery damage
- Third-party bodily injury (Company negligence)
- Third-party property damage
- Passenger liability (Croatian law)
- Crew & staff liability
❌ What IS NOT Covered:
- Personal belongings (phones, cameras, jewelry)
- Medical expenses (except basic requirement)
- Pre-existing conditions
- Client negligence injuries
- Indirect/consequential losses
11.4 Client Travel Insurance (STRONGLY RECOMMENDED)
🛡️ We STRONGLY RECOMMEND Comprehensive Travel Insurance
Essential coverage should include:
- Medical expenses & evacuation
- Personal accident coverage
- Trip cancellation/interruption
- Personal belongings & valuables
- Baggage delay/loss
- Adventure sports (water activities)
Company NOT responsible for costs that adequate travel insurance would cover. Without insurance, you participate at own financial risk.
12Intellectual Property & Photography
12.1 Website Content
All Website content (text, images, logos, "SeaGull Dubrovnik" brand) is Company property. Unauthorized use prohibited.
12.3 Photography and Videography During Tours
📸 Company Photography Rights
The Company may take photographs and videos during tours for promotional purposes, including:
- Social media marketing (Instagram, Facebook, TikTok)
- Website content and advertisements
- Brochures and promotional materials
- Online reviews and testimonials
By participating in a tour, you consent to being photographed or filmed unless you object in writing prior to tour departure.
To Opt Out:
- Email info@seagulldubrovnik.com before your tour with "Photo Opt-Out - [Booking Reference]"
- Inform the Captain at the start of the tour
We will make reasonable efforts to exclude you from promotional materials, but cannot guarantee complete exclusion from group photos.
You retain all rights to photos you personally take during the tour.
13Privacy and Data Protection
Data processed per GDPR and Croatian law. See full Privacy Policy for details.
14Third-Party Services
Stripe (payments), WhatsApp (communication) - subject to their own terms.
15Changes to Services or Terms
Company may modify Services or Terms. Material changes communicated via email or Website.
16Governing Law and Jurisdiction
Governed by Croatian law. Exclusive jurisdiction: Courts in Dubrovnik, Croatia.
17Complaints and Dispute Resolution
Submit complaints via email. Response within 3 days, resolution within 14 days.
18General Provisions
Entire agreement, severability, waiver, and assignment clauses apply.
